Ride for MS 2027: Terms and Conditions
Definitions
1. “Event” means the Event that the client is purchasing as further specified in the attached registration form and other associated documentation.
2. “Event Organiser” means Te Wahapu Trading Co Limited trading as “Northland Experiences”.
3. “MSNZ” means Multiple Sclerosis New Zealand Incorporated (CC10861).
4. “NE Agreement” means the terms and conditions of the Event Organiser that apply to the Event, which are deemed to be incorporated and form part of this Purchase Agreement.
General Terms and liability
5. By agreeing to and completing this purchase, you warrant and agree that you have read these terms and conditions (“Purchase Agreement”) and agree to be bound by its terms as well as the NE Agreement, and any related policies, documentation or obligations specifically referred in, the Purchase Agreement and the NE Agreement.
6. You agree to provide current, complete and accurate purchase and account information for all purchases. You shall also promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that MSNZ can complete your transactions and contact you as needed.
7. You agree that MSNZ are not responsible where the Event Organiser fails to honour or rejects your purchase.
8. Information relating to the Event is wholly and exclusively provided, managed and updated by the Event Organiser or their staff. You agree that the Event is the sole responsibility of the Event Organiser, including the Event's actual management or execution, date, venues, schedules, pricing, promotions, listings, offers, refunds, cancellations or any related matter. No refunds will be offered if the Event is not as you expected.
9. You warrant that you will not initiate with MSNZ any claim, including payment or credit card disputes, or similar claims alleging that your purchase is defective and/or not as described.
10. Neither party shall be liable to the other for any loss of profit, revenue, goodwill or for any indirect or consequential loss or damage arising out of or in connection with the Event and this Purchase Agreement.
11. MSNZ’s total aggregate liability to you (the client) arising under or in connection with this Purchase Agreement or any breach or non-performance of it (including by reason of MSNZ negligence) in contract, tort, under any indemnity or otherwise shall be limited to the sum equivalent to the monies paid by you to MSNZ in the proceeding 12 month period.
12. A deposit of $500 is required within 7 days of registration to confirm your booking. A receipt for tax purposes will be provided and your fundraising page will be set up by MSNZ once the deposit has been received. The remainder can be deposited via regular instalments (in consultation with MSNZ), but the $3,450 must be paid in full by March 01, 2027.
13. In case of conflict between this Purchase Agreement, and the NE Agreement, the latter shall prevail.
Event Changes and Responsibility
14. MSNZ is not responsible for any changes including, but not limited to, the date, schedule, venues, pricing, promotions, listing, offers, refunds, cancellation or any related matter. For any material change to the Event from the time of purchase, it is wholly the Event Organiser's responsibility to inform you of your options going forward.
15. Refunds may only be provided in accordance with the terms of the NE Agreement at the sole discretion of the Event Organiser. MSNZ has no discretion or ability to issue refunds.
16. In no case shall MSNZ be liable or responsible for your reliance on, purchase of, attendance, participation, or any circumstances relating to this Event, including Event cancellations or postponements, request for refunds or ticket resale.
17. You agree to abide with any rules and policies specified by the Event Organiser for the Event (which is solely the Event Organiser responsibility), including but not limited to those set out in the NE Agreement.
Force Majeure
18. MSNZ shall not be responsible or liable if the performance of its obligations under this Purchase Agreement is prevented or limited in any manner by any act or event related to any Force Majeure. Force majeure shall mean unforeseen events beyond MSNZ or the Event Organiser's reasonable control, including but not limited to acts of God, acts of nature, acts of governments, war, pandemic, disease, tide, lightning, flood, explosion, embargo, blackout, lockdown, slowdown, strikes, drought, rebellion, revolution, terrorism.
Jurisdiction
19. This Purchase Agreement will be governed by and construed in accordance with the laws of New Zealand and the parties irrevocably submit to the jurisdiction of the courts of New Zealand.
